U.S. Customs and Border Protection (CBP) released an enhancement which allows them to identify when one recipient (consignee) is importing more than $800 USD worth of aggregated shipments in one calendar day via Section 321 (de minimis entry). While this rule was understood to mean $800 USD in aggregated value per shipper (i.e. individual Chit Chats client), CBP is flagging and refusing shipments across all shippers (ex: individual Chit Chats clients) and carriers (Chit Chats and other shipping companies) crossing into the U.S. via Section 321 that exceed $800 USD in aggregated value to one consignee (recipient).

  • John ships one shipment valued at $750 USD with Chit Chats to Joe Smith at 123 Main Street, New York NY.
  • John ships another shipment worth $750 USD to the same recipient through another carrier similar to Chit Chats.
  • Both carriers are scheduled to cross into the U.S. on the same day.
  • If the other carrier crosses first, they will be permitted because the shipment alone doesn’t exceed the maximum aggregate value.
  • When Chit Chats attempts to cross after the other carrier, Chit Chats would be refused because the recipient would have exceeded the maximum daily aggregate value limit for Section 321.

On Wednesday, August 13th, our trucks were refused entry at each of our border crossings due to shipments being flagged for exceeding the $800 USD value limit. We re-attempted crossing yesterday, August 14th, and while we were successful at two border crossings, one in Ontario was rejected a second time this trip is being re-attempted today.

Since the majority of shipments flagged at the border are for Amazon FBA warehouses, we ask you to refrain from shipping to Amazon FBA warehouses until further notice.

We also ask that you refrain from using multiple carriers to ship to one recipient on a given day. Multiple shipments exceeding $800 USD value to one consignee must be cleared formally with a Customs Broker.

  • Do not split up shipments across multiple carriers, as CBP will flag them upon arrival at the border
  • Notify your recipient(s) of potential delays, especially if your shipments are of high value
