Here\u2019s what we know so far.<\/p><\/div><\/div><div class=\"col-md-6\"><img decoding=\"async\" class=\"h-banner__image\" src=\"https:\/\/chitchats.com\/blog\/wp-content\/uploads\/2025\/01\/shipping-to-us-banner-1.jpg\" alt=\"\" aria-hidden=\"true\"\/><\/div><\/div><\/div><\/section>\n\n\n\n<p><strong>Update July 31, 2025<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Key Points<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De Minimis (Section 321\/Duty Free) Entry into U.S. <strong>suspended as of Aug 29, 2025<\/strong><\/li>\n\n\n\n<li>Chit Chats has DDP solution available<\/li>\n\n\n\n<li>Rising tariffs for Canadian-made goods on Aug 1st<\/li>\n<\/ul>\n\n\n\n<p>Earlier this month, <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1\/text#:~:text=(b)%20Repeal%20of,July%201%2C%202027\">a new bill was passed<\/a>, which includes the <strong>elimination of de minimis entry into the U.S. starting July 1, 2027<\/strong>. In other words, this means duty-free shipments into the U.S. will no longer be allowed as of that date.<\/p>\n\n\n\n<p>Yesterday, July 30th, a new <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/suspending-duty-free-de-minimis-treatment-for-all-countries\/\">Executive Order was published<\/a> declaring the suspension of Duty-Free De Minimis treatment for <strong>all countries, as of midnight, Friday August 29, 2025<\/strong>, which expedites the repeal as noted in the bill passed earlier this month. Barring any changes, this means our last crossing with Section 321 shipments will be <strong>Thursday, August 28<\/strong>.<\/p>\n\n\n\n<p>Further, while the full details have yet to be finalized, <a href=\"https:\/\/www.bbc.com\/news\/articles\/cvg819n954mo\">Trump has indicated that a 35% tariff will apply to Canadian-made goods that don&#8217;t comply with the Canada-U.S.-Mexico Agreement (CUSMA) starting August 1, 2025<\/a>. This would apply to goods currently being tariffed at 25%.<\/p>\n\n\n\n<p>While we are still working to determine how this will affect each of our products, we do want to assure you that our DDP solution (sender pays duties) is still eligible for entry into the U.S. after this deadline, and we are working on alternative products to keep shipments crossing the border at as low a cost as possible.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">Why Accurate Declarations Matter &amp; Repercussions<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any discovered misdeclared shipments during a CBP (U.S. customs) inspection will result in the <strong>entire truck being turned around<\/strong>. In other words, the action of misdeclaring your shipment not only affects you,<strong> but all other Chit Chats clients on the same border-crossing.<\/strong><\/li>\n\n\n\n<li>To protect compliant shippers and keep operations running smoothly, we will be implementing the following penalties if you are found to misdeclare the Country of Origin, value, or any other shipment detail intended to evade tariffs by your local branch or during CBP inspection. All of the following penalties can occur<strong> even on your first offense<\/strong>:\n<ul class=\"wp-block-list\">\n<li>$1000 CAD Chit Chats Administrative Fee<\/li>\n\n\n\n<li>Disposal of misdeclared shipments<\/li>\n\n\n\n<li>Termination of your Chit Chats account (CBP will retain your information, making any future attempts to circumvent tariffs highly likely to fail.)<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Beyond our internal measures, CBP can impose civil penalties up to $50,000 USD and bar you from shipping to the U.S. in the future\u2014regardless of carrier or method.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Key Reminders:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If not already, all shipments crossing the U.S. border must have all products<strong> physically labeled <\/strong>in order to indicate the Country of Origin. You can use a tag or sticker on the item. This is required to avoid any confusion or assumptions during inspections.<\/li>\n\n\n\n<li>All fields\u2014Country of Origin, value, etc\u2014must be accurate and fully completed.<\/li>\n<\/ul>\n\n\n\n<p>Accurate declaration of every shipment is <strong>non-negotiable<\/strong>. <\/p>\n\n\n\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>FAQ<\/summary>\n<p><strong>Q: What if I hand make an item and one of the components is from China, but the actual completed product is made in Canada?<\/strong><\/p>\n\n\n\n<p>A: If more than 51% of the materials and labour was done in Canada, then the product can be considered to be made in Canada.&nbsp;<\/p>\n\n\n\n<p><strong>Q: How are taxes and duties calculated?<\/strong><\/p>\n\n\n\n<p>A: Fees are calculated based on the retail value of the shipment as well as the HTS code.&nbsp;<\/p>\n<\/details>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>Update May 28, 2025<\/summary>\n<p>We understand with all the changes that have happened in the past few months, it is challenging to keep up while also focusing on selling. Here are some guidelines to help you.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Key Points<\/h2>\n\n\n\n<p><strong>It is currently business as usual until the court hearings have concluded and until&nbsp;there is an announcement from the administration.&nbsp;<\/strong><\/p>\n\n\n\n<p>Objects without Country of Origin markings <strong>are non-compliant<\/strong> for Section 321 (USPS-based services for nontariffed shipments)<\/p>\n\n\n\n<p>Country of Origin marking is mandatory for ALL your products. As shared by the driver from the CBP officer on duty:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>For U.S. Customs compliance, every product must have the Country of Origin physically marked on the item itself\u2014not just on invoices or packaging stickers. For any DDP labels purchased prior to this update that have not yet been dropped off, we recommend refunding and repurchasing the label to benefit from the lower tariff.<\/p>\n\n\n\n<p><strong><em>Please note: Refunds for USPS-based services may take up to 21 business days to process.<\/em><\/strong><\/p>\n<\/details>\n\n\n\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>Update May 6, 2025<\/summary>\n<p>As noted in yesterday\u2019s update, U.S. CBP is thoroughly checking parcels for verification of Country of Origin, and immediately refusing our entire truck upon discovery of a <strong>single <\/strong>misdeclared or ambiguous Country of Origin. Shipments crossing at the New York border were refused again, and we are awaiting the status of the shipments crossing in Washington.<\/p>\n\n\n\n<p>Given the amount of shipments that need to be verified, any shipments that have been handed off to Chit Chats, but have yet to be inducted, are in the process of being returned to their branch of origin to be physically checked before being allowed to cross the border. These are essentially our USPS-based postage services (Chit Chats U.S. Select, U.S. Edge, USPS Priority Mail, etc.), and they will require you to provide a valid <a href=\"https:\/\/support.chitchats.com\/en\/support\/solutions\/articles\/47000426730-what-customs-information-do-i-need-to-provide#Harmonized-System-Tariff-Codes\">HTS code<\/a> and <a href=\"https:\/\/support.chitchats.com\/en\/support\/solutions\/articles\/47001272800-what-is-manufacturer-information-and-do-i-need-it-\">manufacturer information<\/a> for each shipment.
